Your privacy matters. This Policy explains how Avioth collects, uses, stores, and protects your personal information when you visit avioth.com or otherwise interact with us. Please read it carefully.

1. Who We Are

This Privacy Policy applies to Avioth LLC ("Avioth", "we", "us", or "our"), a limited liability company organized under the laws of the United States, operating the website avioth.com (the "Site"). It explains how we collect, use, store, and protect personal information when you visit the Site, contact us, or otherwise interact with Avioth.

2. Information We Collect

Information you provide to us directly: name, email address, company name, phone number (optional), and any messages or attachments you submit through our contact form or send to us by email.

Information collected automatically when you visit the Site: IP address, device type, operating system, browser type, referring URL, pages visited, approximate geographic location (derived from IP), and basic interaction data through analytics tools.

Information from third parties: in limited cases we may receive information about you from service providers we use (such as email providers, anti-spam services, or analytics platforms) under contractual obligations consistent with this Policy.

3. How We Use Your Information

We use your information to: respond to inquiries you submit through the Site or by email; communicate with you about our products, services, and engagements; provide and improve our products and services; analyze and improve the Site itself; comply with legal obligations; and prevent fraud, abuse, and security incidents.

We do NOT use your personal information for advertising, profiling, or any form of automated decision-making that produces legal effects on you. If we ever introduce such uses in the future, this Policy will be updated and you will be notified.

4. Information Sharing and Disclosure

Service providers: we share information with service providers we use to operate Avioth, including hosting providers, email providers, analytics platforms, and payment processors. These providers are bound by contract to handle your information consistent with this Policy and only for the purposes we authorize.

Legal requirements: we may disclose information to comply with legal obligations, court orders, subpoenas, lawful government requests, or to protect the rights, property, or safety of Avioth, our users, or others.

Business transfers: in the event of a merger, acquisition, financing transaction, bankruptcy, or sale of assets, your information may be transferred to the successor entity. We will notify you of any such transfer where required by law.

We do NOT sell, rent, or trade your personal information to third parties for their own marketing purposes.

5. Third-Party Links and Services

The Site may contain links to third-party websites, services, or resources, including links to our own products such as TalentForge. Avioth has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites or services. We strongly advise you to review the privacy policies of every site you visit. Your interaction with third-party sites is entirely at your own risk and is not governed by this Privacy Policy.

6. Data Retention

We retain personal information only as long as necessary to fulfill the purposes outlined in this Policy and to meet our legal, accounting, and reporting obligations.

Contact form submissions and inquiry emails: retained for up to 3 years from last interaction unless deletion is requested earlier.

Analytics data: aggregated and retained for up to 26 months.

Billing records (where applicable): retained for 7 years to comply with legal and tax requirements.

You may request deletion of your personal information at any time by contacting privacy@avioth.com, subject to our legal retention obligations.

7. Data Security

We implement reasonable industry-standard security measures including encryption in transit (TLS), encryption at rest where applicable, access controls, regular security reviews, and employee security training. Avioth's infrastructure is hosted on AWS, which provides physical, network, and environmental security controls.

However, NO METHOD OF TRANSMISSION OVER THE INTERNET OR ELECTRONIC STORAGE IS 100% SECURE. While we strive to protect your information using commercially acceptable means, WE CANNOT GUARANTEE ABSOLUTE SECURITY. You acknowledge and accept this inherent risk by using the Site and providing information to us.

8. Data Breach Notification

In the event of a data breach that is likely to result in a high risk to your rights and freedoms, Avioth will notify affected users without undue delay and, where required by law, within 72 hours of becoming aware of the breach. Notification will be provided via email to the address we have on file for you and/or via a prominent notice on the Site. The notification will include: the nature of the breach, the categories and approximate number of individuals affected, the likely consequences, and the measures taken or proposed to address it.

9. Your Privacy Rights

GDPR Rights (EU/UK Users): you have the right to access your data, the right to rectification of inaccurate data, the right to erasure ("right to be forgotten"), the right to data portability, the right to restriction of processing, the right to object to processing, and the right not to be subject to solely automated decision-making.

CCPA Rights (California Users): you have the right to know what personal information is collected, the right to know whether personal information is sold or disclosed and to whom, the right to opt out of the sale of personal information (we do not sell personal information), the right to request deletion of personal information, and the right to non-discrimination for exercising your rights.

Other jurisdictions: residents of other states and countries may have additional or similar rights under their local data protection laws. We will honor all applicable rights in good faith.

To exercise any of these rights, contact privacy@avioth.com. We will respond within 30 days. We may need to verify your identity before processing your request.

10. Cookies and Tracking

We use minimal cookies on the Site:

Essential cookies: required for basic site functionality and security. Cannot be disabled.

Analytics cookies: used to understand how visitors use the Site so we can improve it. These collect aggregated, mostly anonymized data such as page views, session duration, and approximate geographic location.

We do NOT currently use third-party advertising or marketing cookies. If we ever introduce them in the future, this Policy will be updated and you will be given the opportunity to consent or opt out.

You may adjust cookie preferences through your browser settings, though disabling essential cookies may impair Site functionality.

11. International Data Transfers

Avioth is based in the United States, and your data may be processed in the United States and other countries where our service providers operate. These countries may not provide the same level of data protection as your country of residence. Where required by law, we use Standard Contractual Clauses (SCCs) approved by the European Commission and other appropriate safeguards to ensure adequate protection for international data transfers.

12. Children's Privacy

The Site is not intended for, directed at, or designed to attract users under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16 without verifiable parental consent, we will take immediate steps to delete that information. If you believe we may have inadvertently collected information from a child, please contact privacy@avioth.com immediately.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AVIOTH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, ANY DATA BREACH, UNAUTHORIZED ACCESS TO YOUR DATA, OR ANY OTHER PRIVACY-RELATED INCIDENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR USE OF THE SITE IS VOLUNTARY AND ENTIRELY AT YOUR OWN RISK.

14. Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes in our practices, technology, legal requirements, or other factors. The "Last updated" date at the top of this page reflects the most recent revision. We will notify you of material changes via email (where we have your address) and/or via a prominent notice on the Site at least 30 days before the changes take effect. Your continued use of the Site after the effective date of any updated Policy constitutes your acceptance of the changes.
